Amendment

DEIC voted on Aril 15 following the public hearing to update the DOI plan to include an exception to "Exempt the District from the mandatory DAEP removal in TEC Section 37.006 (a)(2)(c-2)."

Current Law

TEC § 37.006(a)(2)(C-2) states that a student must be removed from class and placed in DAEP if the student (1) within 300 feet of school property, or (2) while attending a school-sponsored or school-related activity, possesses, uses, sells, gives, or delivers to another person an e-cigarette, as defined by Section 161.081 of the Texas Health and Safety Code. This mandatory DAEP placement for “vaping” is administratively burdensome and removes students who pose no direct threat to their peers from their regular educational setting.

The District shall be excepted from the requirements of TEC § 37.006(a)(2)(C-2) so that school administrators may, but are not required to, place students who violate  TEC § 37.006(a)(2)(C-2) in DAEP.
